AI Product Terms
1. Processing by Azure
When using Sleek Intelligence AI, all processing of personal data—including any data contained in Inputs (as defined below) or other Customer Data—is performed using Azure hosted instances in the EU. All processing activities will be governed by the Data Processing Agreement (DPA) in place between Sleekplan and the Customer.
2. Location of Processing
By electing to use an AI Product, Customer acknowledges that personal data will be processed by Azure, in accordance with the relevant documentation and security measures outlined by Azure.
3. Electronic Protected Health Information (ePHI)
Customer is solely responsible for the creation, content, and accuracy of any electronic protected health information (ePHI) submitted to an AI Product. Customer must ensure that any Inputs containing ePHI are accurately matched with the corresponding Outputs, and that these Outputs are delivered to the appropriate end users.
4. Inputs and Outputs
“Inputs” refers to any data, content, or information (in any format) submitted to an AI Product by Customer, its authorized users, or any other person, including conversation data, queries, and any personal data therein. “Outputs” refers to any results generated by an AI Product based on such Inputs. Both Inputs and Outputs are considered Customer Data under the Agreement and are subject to its rights, restrictions, and obligations. Customer agrees to provide only those Inputs for which it is duly authorized, and acknowledges that third parties may also provide Inputs resulting in similar Outputs. Customer has no claim over any such third-party generated results.
5. Accuracy
Outputs generated by Sleek Intelligence AI may contain inaccuracies and may not reflect complete, current, or correct information. Customer should not rely on Outputs without independent verification and human review. Sleekplan does not offer any warranties or indemnities regarding the accuracy or reliability of these Outputs, and the AI features are not intended to replace professional advice or services.
6. Transparency
Customer must ensure that:
All users are informed when they are interacting with an AI system;
All Outputs are clearly marked as being generated or influenced by artificial intelligence; and
There is no misrepresentation that Outputs are human-generated.
7. Rights to Use
Customer authorizes Azure to use Inputs, Outputs, or other Customer Data as necessary to provide the AI Product, comply with applicable laws, and enforce its policies. Sleekplan restricts Azure from using Customer Data for training or enhancing its services beyond what is necessary to provide the agreed functionality.
8. Restrictions on Use
In addition to any general obligations under the Agreement, Customer represents and warrants that:
The AI Products will not be used in any manner that violates Sleekplan’s Acceptable Use Policy or any third-party policies applicable to the use of the AI Products.
Customer, nor any permitted user, will use the AI Products to develop or train a competing model or system to Azure’s services.
Customer will not use any method to extract or infer information from an AI Product beyond its intended functionality, except as permitted by law.
Customer is solely responsible for all use of the AI Product by its authorized users.
Customer agrees not to use the AI Products to generate Outputs specifically for creating synthetic training data intended to develop or train a model or system that substantially competes with Azure’s AI services.
9. Pricing and Usage Limits
By using an AI Product, Customer agrees to the pricing specified on the Pricing Page or in the Order Form. Sleekplan may monitor, limit, or suspend usage of an AI Product if it determines that such usage may bypass or circumvent rate limits, compromise security, or otherwise negatively impact the integrity or commercial viability of any services.
10. Availability
No service level agreement or uptime guarantee is provided for any AI Product.
